Response to a request for stakeholder engagement on the introduction of a unique individual identifier for use in the Irish criminal justice system

Abstract
This briefing note is written in response to the Department of Justice Consultation on a Unique Identifier for the Criminal Justice System and the related discussion document issued by the Department of Justice on March 2025. In this paper, we respond (1) to the proposal to introduce a unique identifier (UID) for the criminal justice system; (2) the proposal to use the PPSN in developing the UID; (3) the proposal to facilitate research via linking demographic census data to criminal justice data; (4) the proposal for a UID to apply to crime victims; and (5) the use of the UID beyond recorded and detected crime (for which statistics are produced by the Central Statistics Office) and for other encounters with An Garda Síochána (eg, as a victim of crime; garda stop; garda stop and question; garda stop and search; home searches).
Where data is collected and shared within or across the criminal justice system, it must be done in a manner which complies with standards established in national, European and international legal and human rights frameworks: in short, data privacy laws require that the collection and sharing of the data be lawful, necessary, and proportionate in a democratic society. The introduction of a UID either within or across criminal justice institutions must comply with these principles. As well as these general issues with respect to data protection and data privacy,
